TERMS OF SALE

1. About these terms

These Terms of Sale apply to every order you place on tidelace.com (the "Site"). Our Shipping Policy, Return Policy, Refund Policy and Privacy Policy are part of these terms.

By placing an order, you agree to them. Please read them carefully, especially sections 11 (Limited Warranty), 12 (Limitation of liability) and 14 (Disputes).

2. Who can buy

You must be at least 18 years old (or the age of majority where you live), or place the order with the involvement of a parent or guardian. We sell to consumers in the United States for personal use. We may refuse or cancel orders that appear to be for resale, that use a fraudulent payment, or that ship outside our delivery area.

3. Products, age grading and safety information

  • We try to show products, colors and sizes as accurately as possible. Small color and finish variations can occur between production batches.
  • Read the warnings and instructions on the package and product page before use. Our products are not toys unless we say so. Keep small parts (such as earrings and clasps) away from young children.
  • Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Stop using any product that causes irritation.

4. Waitlists, founding offers and pre-orders

  • Joining a waitlist, including through our "Reserve" button, is free and does not create an order or any obligation to buy. "Reserve" means you will get early access and a founding code if we launch. Products on a waitlist are in development and may not be produced.
  • If we promise waitlist members a launch offer (for example "Waitlist members: 10% off at launch"), we will honor it as described on the sign-up page, against our regular price.
  • If we ever take pre-orders, the product page will show an estimated ship date based on our confirmed schedule, and our Shipping Policy explains your right to cancel if we are delayed.

5. Prices and payment

  • Prices are in US dollars. Applicable sales tax and shipping charges are shown at checkout before you pay.
  • We may correct pricing errors. If an item was mispriced, we will contact you before shipping and let you choose to pay the correct price or cancel for a full refund.
  • Payment is taken when you place the order, through Shopify Payments.
  • "Compare at" or "was" prices are prices at which we actually offered the item for a reasonable period, or genuine market prices.

6. Order acceptance

Your order is an offer to buy. We accept it when we ship it (and send you a shipping confirmation). We may cancel an order before shipping (for example if an item is out of stock or if we suspect fraud), in which case we refund you in full within 5 business days.

7. Shipping, delivery and risk of loss

Delivery times and costs are explained in our Shipping Policy. Risk of loss passes to you when the package is delivered to your shipping address. If a package is lost or damaged in transit, we will replace or refund it as described in our Shipping Policy.

8. Returns and refunds

See our Return Policy and Refund Policy. Unworn pieces can be returned within 30 days, initial bar bracelets included (initials are stocked letters, not custom work). For hygiene, huggie earrings can be returned only in their sealed bag, unless defective. We list any final-sale item on the product page before you buy.

9. Personalized products

For engraved or personalized items, please check spelling before ordering. We produce the text exactly as you enter it. We will not engrave content that is offensive, infringes someone else's rights (such as trademarks or logos you don't own) or is unlawful.

10. Reviews

We welcome honest reviews, positive or negative, and we publish them according to our review guidelines. We never offer rewards in exchange for a positive review and we don't remove reviews because they are negative. Do not post content that is false, abusive or infringes others' rights.

11. Limited Warranty

Our written limited warranty for each product is on our Warranty page (https://tidelace.com/pages/warranty) and on the card in the box. It is available before you buy.

12. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product, and we are not liable for indirect, incidental or consequential damages. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

13. Intellectual property

All content on the Site (brand names, logos, photos, videos, text and designs) belongs to Mehdikh LLC or its licensors. Other trademarks mentioned (for example to describe compatibility) belong to their owners; we are not affiliated with or endorsed by them.

14. Disputes

  • Talk to us first: most problems are solved quickly. Email hello@tidelace.com with a description of the issue; we will try to resolve it within 30 days.
  • Governing law: these terms are governed by the laws of the State of New Mexico and applicable US federal law, without regard to conflict-of-laws rules, except where the consumer-protection laws of your state of residence apply.
  • Small claims: either of us may bring a qualifying claim in small-claims court in your county of residence.

15. Changes

We may update these terms from time to time. The version in force when you place your order applies to that order.
